The Collapse of the 28-Clause Peace Initiative for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the crisis sparked by the announcement of a new 28-point plan for ending the war appeared – momentarily – to have been contained. A senior US official spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its response: another massive barrage of missile and drone strikes on Kyiv.

The Pattern of Peace Talks and Military Action

The succession of contrasting events captured the harsh reality of the recent timeframe. By day, diplomatic battles are fought: hopeful statements are issued from various governments. Considerable effort is expended on managing certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, conflict continues to be the primary tool for achieving "resolution".

Nocturnal Warfare

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was exposed. Ukraine is equipped to monitor rocket firings from Russian territory, a ability afforded by current data. From vantage locations, defense planes that had been scrambled to counter approaching cruise missiles roared overhead – modern combat jets provided to Ukraine by European allies.

Shortly after, Kyiv's air-defence systems activated: several firings targeted at a Russian ballistic missile. This was a sophisticated defense system at work, most likely supplied through partner states. Every launch creates sudden vibrations, shaking the windows. The brief panic quickly transforms into grim resignation: perhaps the incoming missile won't hit its mark this time, protecting urban areas from catastrophe and further power outages.

Ongoing Risks

Soon after, a heavy machine gun fired at a drone in the vicinity, part of a rapid response unit – almost certainly allied-provided weaponry. Sadly, the shots failed to hit the opposing UAV – it continued its flight toward its destination.

With pauses, this carried on until dawn. Kyiv awoke to the daybreak reports: seven people killed, damage and utility failures in numerous residences as a result of the evening attack. As typically, everyone still went about their day – enduring hostilities. But those full day illustrated Ukraine's critical military reliance on international aid – a reliance that neighboring countries are demonstrably unable to fill in the short term.

Ineffective Peace Efforts

The comprehensive proposal from Washington provoked deep reactions, debate and profound anxiety – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and international summits.

Every new proposal from US leadership adheres to the same pattern: a political offensive against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They manage the tension but never actually win the battle. This cycle will, no doubt, continue.

Strategic Calculations

It is convenient to criticize particular leaders of repeatedly advocating Moscow's conditions. But that does not seem to be the entire situation. US administration operates on a premise well known to seasoned negotiators: you cannot achieve through diplomacy what you have failed to defend militarily. The White House believes that it is unrealistic to pressure the Kremlin to abandon the territory that it already controls in Ukraine's south or east.

The challenge is that while recognising this factual reality, American administration does little to prevent Kremlin actions, through statements or actions, from assuming that the situation will not change more in its benefit in the near future.

Divergent Views

Therefore, the Kremlin is certain that duration works to their advantage – that Ukraine and its supporters are coming close to fatigue. Their incentive to accept conditions that does not give them the largest achievable advantage is almost completely absent. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's leader remains highly assured in the result.

On the contrary, Kyiv believes that Ukraine can still endure, gradually sacrificing people and territory but preventing a entire defensive failure until conditions improve in its benefit.

Existing Situation

Objectively, there are no genuine requirements for a armistice. Now, individual motivations are becoming relevant: leadership ambitions to mediate resolution and achieve global acclaim, and Ukrainian leadership's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the flag against any plan Kyiv finds unsuitable, so that their focus does not switch to homefront challenges. And although their objective will now be much harder after current events, it remains quite doubtful that this will modify their basic position.

These two forces are driving the talks.

Summary and Prospects

It took a only one week to eliminate the 28 points of the most recent proposal. Forceful and unpredictable management of the matter by US administration, pushback by Ukraine and the rest of Europe, along with soothing efforts of negotiators, and finally, latest revelations, all served their function.

While new proposals based on established approaches are forthcoming, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are founded on Moscow's terms and demonstrate specific hesitation to change the course of events, if they maintain solidarity and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the foreseeable future, primarily depend on continued Western support.
